Welcome to #OurChildren Legal Services. Please read these terms and conditions of use (“Terms”) carefully as they govern your access to and use of the #OurChildren Legal Services platform, including all materials, resources, services, information and content available through our website at https://nashidity.info (“Platform”). By using our Platform, you signify that you have read, understand and agree to be bound by these Terms. If you do not agree to these Terms, do not use our Platform. These Terms are a binding legal agreement between you and #OurChildren Legal Services (“we,” “us,” or “our”).

#OurChildren Legal Services provides general legal information, guidance and assistance. This includes information, resources and advice relating to adoption, guardianship, foster care and other family-based child welfare matters in the United States. Please read these Terms carefully to ensure that you understand your rights and responsibilities, and our rights and responsibilities when using our Platform.

About #OurChildren Legal Services

#OurChildren Legal Services provides a volunteer-driven legal information platform created to support individuals and families dealing with adoption and other family law issues in the United States. The Platform is dedicated to prospective adoptive parents, guardians, foster parents, family law professionals, and all those seeking access to accurate information and assistance relating to child welfare.

The mission of the Platform is to provide users with free access to step-by-step legal guides, consultations with attorneys, document preparation help, psychological support, news and resources, and an active legal network. The Platform is operated on a volunteer and donor-funded basis and is committed to ensuring that these core services remain free of charge to our users.

Agreement to the Terms

As a condition to your use of any portion of the #OurChildren Legal Services Platform, you agree to be bound by these Terms of Use, as well as our Privacy Policy and any other policies, rules or guidelines posted on the Platform. If you are using the Platform on behalf of an organization or other entity, you also represent and warrant that you have all authority necessary to bind such organization to these Terms. If you do not wish to be bound by these Terms, you must immediately cease all use of the Platform.

Eligibility and Authority of User

To access the #OurChildren Legal Services Platform, you must be at least 18 years old or of legal age in your jurisdiction of residence, whichever is greater. When you access the Platform, you represent and warrant that you are able to create a binding contract, and that all information provided to create an account on the Platform is accurate, current, and complete. When registering an account or acting on behalf of an organization, you additionally represent and warrant that you have authorization to act on behalf of the organization.

Services Description

#OurChildren Legal Services provides a range of free resources and services to people considering adoption, guardianship, and foster care as well as child welfare concepts in general. Services cover:

  • Step-by-step online legal adoption guides for both US citizens and foreign nationals
  • Legal document support, including automated court applications & documents
  • Free consultations with licensed US adoption lawyers and family law experts
  • Free psychological consultation services to help with emotional planning for adoption
  • Legal news, updates, and reform of child welfare law
  • Handpicked database of children available for adoption, including video profiles and confirmed success stories
  • “Mom, I’m Home!” podcast for emotional and legal support
  • Verified links to government sites and child welfare databases
  • Guidance to contact regional child welfare and legal service providers

All services listed above are subject to these Terms and are provided at our discretion, with or without prior notice. We reserve the right to change or discontinue existing features or services, or add new features or services, without liability; certain new features or services may be conditioned on acceptance of additional terms.

Services are Free; Donations Invited

All core services and resources offered through the Platform, including legal guides, individual legal consultations, and document preparation, are provided to the community free of charge. #OurChildren Legal Services is a completely volunteer and donor-supported service. We sometimes accept donations to assist with our mission. However, contributions are entirely voluntary and do not determine the level or range of services utilized. No payment is solicited or required as a condition to view or access any portion of the Platform.

Legal Disclaimer and No Formation of Attorney-Client Relationship

#OurChildren Legal Services offers information, materials and general guidance related to adoption, guardianship, foster care and family law.

Although our staff includes licensed, knowledgeable legal professionals, all content within the Platform is designed for informational purposes only and does not constitute legal advice.

Your access to and use of the Platform, participation in consultation or access to a legal guide shall not be construed as forming an attorney-client relationship between you and #OurChildren Legal Services, its volunteers, or its legal services partners. You must consult directly with a lawyer in your jurisdiction on any specific legal advice regarding your personal circumstances or matters.

Platform Usage and User Expectations

You will use the #OurChildren Legal Services Platform for lawful purposes and according to these Terms. You are solely responsible for your conduct while using the Platform and you must not:

  • Violate any law or regulation, federal, state or local
  • Use the Platform for any fraudulent, abusive, or unlawful purpose
  • Impersonate another person or entity, or misrepresent
  • Attempt to gain unauthorized access to any part of the Platform, the Platform’s accounts and systems
  • Interfere with or disrupt the security or operation of the Platform
  • Upload, transmit, or distribute any viruses, malware or other malicious computer code
  • Post, transmit or share on the Platform any content that is harassing, threatening, defamatory, obscene or otherwise objectionable

We may suspend or terminate your use of the Platform if you violate these Terms, or for any other reason at our discretion.

Accounts, Registration and Member Obligations

Some of the available features or services on the Platform may allow you to create an account or to register for access and use (“Registration”) with #OurChildren Legal Services. In connection with Registration, you agree to provide accurate, current and complete information about yourself.

You are responsible for maintaining the confidentiality of your account credentials and you are fully responsible for all activities that occur under your account.

You agree to immediately notify us if you become aware of any unauthorized use of your account or any breach of the security of your account. We are not liable for any loss or damage arising from your failure to comply with this Section.

Privacy; Protection of Non-Public Information

#OurChildren Legal Services (“#OurChildren” or “Platform”) is dedicated to safeguarding your privacy. Our separate Privacy Policy contains the specifics as to how, including the purpose, we collect, use, maintain, store and otherwise handle your Personally Identifiable Information (PII). By using our Platform you acknowledge and agree to the collection, use, maintenance and storage of your Personally Identifiable Information in a manner as set forth in the Privacy Policy.

We utilize security measures that are industry standards; however, we cannot ensure or warrant complete security. You assume all risk in connection with the information you share on the Platform.

IP Rights

All content, materials and resources contained in the #OurChildren Legal Services Platform including, but not limited to, text, graphics, logos, images, videos, podcasts, software and documentation (collectively, the “Content”) are the exclusive property of #OurChildren Legal Services or its licensors and are protected under U.S. and international copyright, trademark and other intellectual property laws.

You may access, view and print content in connection with your use of the #OurChildren Legal Services Platform for your personal, non-commercial purposes only. You may not reproduce, distribute, modify, transmit, display or perform, publish, license, create derivative works from or sell any Content obtained from the #OurChildren Legal Services Platform without our prior written consent.

User Content

The Platform may permit you and others to submit, post, or upload content on the Platform, including but not limited to questions, comments, success stories, or other materials (“User Content”). You are solely responsible for your User Content, and you represent and warrant that you have all necessary rights to submit your User Content. You agree that you will not submit, post or upload any content that is unlawful, infringing, defamatory, or otherwise objectionable. You grant #OurChildren Legal Services a worldwide, non-exclusive, perpetual, royalty-free license to use, reproduce, adapt, publish, translate, distribute and display such user content in connection with our services and mission. We may remove any User Content at any time in our sole discretion.

Third Party Links/Resources

As part of your use of #OurChildren, you may find links directing you to third-party websites, resources, or services that are not owned or controlled by #OurChildren. We link to these outside resources for your convenience and informational purposes only. These third-party materials and all other third-party materials referenced within the #OurChildren Sites are not owned or controlled by #OurChildren; we do not endorse or assume responsibility for the content, products, services, or practices of any third-party resource.

Your use of outside resources is at your own risk subject to that third party’s terms and privacy policies. We suggest that you read those policies before accessing or using an outside resource.

No Warranty Disclaimer

The #OurChildren Legal Services Platform and all related content, services and features are provided by us on an “as is” and “as available” basis without any warranties of any kind. To the fullest extent possible under the law, we disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement and accuracy of information. We are not liable that the Platform will be unavailable on an uninterrupted or secure basis or will be free of errors, viruses or other harmful code or components. We make no warranty regarding the suitability, accuracy, availability, completeness or reliability of any information or services.

Limitation of Liability

To the fullest extent permitted by applicable law, #OurChildren Legal Services, founders, partners, volunteers, employees, agents and affiliates will not be liable for any direct, indirect, incidental, special, consequential or punitive damages arising from or related to your use of, or inability to use, the Platform, including without limitation any loss of data, revenue, profits, goodwill or other intangible loss, even if we have been advised of the possibility of such damages.

Your exclusive and sole remedy for any dissatisfaction with the Platform (including content) is to stop using the Platform.

Indemnity Obligation

You agree to indemnify, defend, and hold harmless #OurChildren Legal Services, along with its founders, partners, volunteers, employees, agents, and affiliates, from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that arise out of or are related to:

  • Your use or misuse of the Platform
  • Your violation of these Terms
  • Your violation of any applicable law or the rights of any third party
  • Your User Content that you submit or contribute to the Platform

Modifications to the Terms/Platform

#OurChildren Legal Services (the Service) may, from time to time, need to update, edit, change or otherwise revise these Terms at its discretion. All changes shall be effective immediately upon posting revised Terms on the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of those revised terms.

#OurChildren Legal Services (the Service) also reserves the right to make changes to, suspend, or discontinue all or part of the Platform, services, or features at any time and in its sole discretion with or without notice. We will not be liable to you or any third party should we choose to exercise our right to make such changes.

Access Termination/Suspension

We may, in our sole discretion, suspend or terminate your use of all or a portion of the Platform, for any reason or no reason and without liability to you, including, but not limited to, breach of these Terms, suspected fraud or other illegal activity, or at your request.

Upon termination, all rights granted to you under these Terms immediately terminate and you must cease all use of the Platform. Some provisions of these Terms, including those pertaining to intellectual property, disclaimers, limitation of liability, indemnification, arbitration and other dispute resolution provisions shall survive termination.

Jurisdictional Issues/Choice of Law/Forum

These Terms of Use and any dispute(s) arising out of or relating to your use of the #OurChildren Legal Services Platform will be governed by and construed in accordance with the laws of the State of Texas, without giving effect to conflicts of law principles. You agree that exclusive jurisdiction and venue exists in the state and federal courts located in Houston, Texas for any and all disputes and causes of action arising out of or relating to these Terms or your use of the Platform.

Dispute Resolution

Any dispute, controversy or claim arising out of or relating to these Terms or the use of the Platform must be tried on an amicable basis (without resorting to any court) by contacting us directly at [email protected]. The parties further agree to submit any such unresolved dispute to binding arbitration in Houston, Texas before a single arbitrator in accordance with the American Arbitration Association (“AAA”) rules. The ruling made by the arbitrator is final and binding. Each party will bear its own cost and expenses related to the arbitration.

Overseas Use/Compliance

#OurChildren Legal Services is hosted in the United States and is intended for use by users located within the United States. Users are responsible for ensuring compliance with applicable local laws. By accessing the Platform from outside the United States, users agree that they will not be in violation of any such local laws. Users also agree not to use the Platform in any country or jurisdiction where any of the content, services, or these Terms would be illegal or unenforceable.

Children/CPPA

#OurChildren Legal Services Platform is not intended for use of any individual under the age of 18. We do not want to collect information from children under the age of 18. If we learn that we have collected personal information from a child under age 18 without verification of parental consent, we will take action to delete such information. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us at [email protected].

No Waiver/Severability

No further or continuing waiver by #OurChildren Legal Services of any provision of these Terms or the Privacy Policy or Returns and Exchange Policy shall be deemed a further or continuing waiver of such provision, and any failure of #OurChildren Legal Services to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is found to be invalid, unlawful or unenforceable by a court of competent jurisdiction, such provision will be changed and interpreted to accomplish the intent of the parties to the fullest extent possible under applicable law and the remaining provisions of these Terms will remain in full force and effect.

Entire Agreement

These Terms of Use, together with our Privacy Policy and any additional terms or policies that we post on the Platform, constitute the entire agreement between you and #OurChildren Legal Services regarding use of the Platform and supersede and replace any prior or contemporaneous agreements, communications, or proposals, whether electronic, oral, or written, between you and us.

Assignment

You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. #OurChildren Legal Services may assign its rights and obligations under these Terms without restriction.
